Description: A group of elementary school teachers came to us after another attorney told them to go back home because their cases were impossible. We disagreed because although the case law had made such applications difficult, it did not make them impossible. We had to go beyond just researching the law, but had to work with the employer to learn about how they operated with the local university. Our hard work paid off, as we were able to obtain H-1B approvals after the cap had been reached by arguing that the teachers were eligible for a cap exemption. The USCIS agreed and issued the approvals.
