    Current processing time for I730 is 5 months. You can submit a case inquiry to USCIS. If you have already done so, you can submit a case assistance request to CIS Ombudsman at https://www.dhs.gov/case-assistance

    You can't use your friend H1B. The employer's H1B petition will be cap exempt as it has already been counted toward the cap. However, if the old employer withdrew the approved H1B, then the new H1B petition will be subject to cap.

    NIW is a self sponsored petition. You don't have to be sponsored by your employer. Regarding your NIW case, you should have an attorney review your resume.

    If you are not in the U.S., the employer can not extend your status as you do not hold a h1b status. Amendment is not a good idea as it will not extend the validity period. The employer can file the h1b as a new petition although is has to pay $500 fee again.

    I-140 approval notice is mailed to the attorney of record or the employer if the employer was not represented by an attorney.

    If Company A withdraw the H1B petition, USCIS will deny Company's B's H1B petition. USCIS only approves Company B's H1B petition after USCIS approves the Company A's petition.

    Refusing to release receipt and approval notices to beneficiaries is a prevalent practice. If you are a client of the attorney who filed the H1B for the employer, the attorney must release the notice you.

    It is possible for medical reason. They have to have a note from a doctor, and the note has to explain her medical conditions, treatment plan, and reasons for the whole family member to stay with the child with sufficient detail.
