While technically you may have a claim for negligence, the likelihood that an attorney will take on this case is low in Texas. Medical malpractice claims in Texas have fallen victim to tort reform making it almost impossible to recover even when people are killed by the negligence of medical providers.

  • When you settle a claim out of court what is the procedure your attorney goes thru to get your payment. How long does it take?

I was in a car accident . An offer was made and accepted on September 29. How long does it take before a check is issued?

    Justin’s Answer

There are a lot of factors that can determine how long it takes to receive settlement proceeds. I always advise my clients that it typically takes 45-60 days unless they have outstanding Medicare/Social Security/Child Support or other liens that can take longer to resolve. Further, how long it takes to get the release, negotiate the release, get the check, clear the check, negotiate all outstanding bills/liens/expenses, etc can all affect how long it takes to distribute a settlement.

    Justin’s Answer

I agree with the previous comments. You may have a claim for sexual assault against the perpetrator and potentially you could have claims against the boarding school for things such as negligent entrustment, negligent hiring, negligent training, negligent retention, and other potential avenues. As the previous commenter noted, you need to make sure you consult with a lawyer soon as to protect your claims.

    Justin’s Answer

You need to consult with your divorce attorney regarding this question. However, the fact that you received a "personal injury settlement" should not affect whether or not you are ordered to pay someone else's attorney fees.

    Justin’s Answer

You should speak to an antitrust lawyer and determine if they are being anti-competitive. They may have a legal basis for not selling to you but you should speak to a lawyer with experience in handling anti-trust matters. Please e-mail me if you have any more questions.
