It does not happen with every case, but from time to time, we have been able to get an Applicant's Preliminary Determination Letter recalled. The result has been that the Applicant does not have to attend a Character/Fitness Hearing before a three attorney panel of the Texas Board of Law Examiners. With substance abuse issues, it is possible to show that the useage has completely ceased and that in all probablity no future use will occur. There are other cases in which there may have been a financial issue that has now been resolved, so a decision is made that a hearing will not be necessary. As we stated earlier, every case is unique but the option of getting the PDL recalled does exist, and where appropriate should be a goal fo the Applicant and Counsel undertaking issues with the BLE that need to be addressed. Be sure you inquire with counsel, whehter the withdrawal of the PDL is an viable option for your case. Bob Bennett
