Description: Plaintiff alleges that on Saturday, March 29, 2008 at about 3:30 p.m., Mr. Rodriguez was at the Pioneer Drilling #4 worksite in Zapata County, Texas. Mobile Crane was Mr. Rodriguez’s employer, and Mobile Crane was contracted to assist in moving a rig. As part of the rigging move, Mr. Rodriguez was on one knee hooking floor plates to a crane so the floor plates could be moved. Above Mr. Rodriguez, two Pioneer employees, names unknown, were hammering on a large pin. This pin was for the A-leg. As the workers knocked the pin free, it flew towards Mr. Rodriguez, hitting him on the back of the head, neck, and mid-back. Mr. Rodriguez lost consciousness and suffered serious personal injuries.
