As a member of this very special group, Mr Floyd is among the rarified ranks of some 7000 Texas attorneys who are Board Certified in 18 areas of expertise. Considering that there are more than 70,000 licensed attorneys who practice in Texas, this is an exceptional achievement because “Board Certification” means an attorney has substantial, relevant experience in a Criminal Law as well as demonstrated, and tested, special competence in this area of law.”

With Board Certification John T. Floyd can expressly hold himself out as a “specialist” in the field of criminal defense work. In fact, board certified lawyers are the only attorneys allowed by the State Bar of Texas to publicly assert that they are specialists in any given area of law. Given the bad reputation some criminal defense attorneys have garnered in recent years in Texas, it is a distinguished honor that Mr. Floyd can hold himself up within the legal profession as an attorney board certified in excellence, skill, and professionalism. It took years of criminal defense work in the trenches of both state and federal courts to develop the skills and abilities to achieve this Board Certification.

Prior to becoming board certified a lawyer must demonstrate substantial involvement and special competence in criminal law practice. This includes providing information proving the lawyers previous experience in criminal cases and extensive professional references that can vouch for the attorney’s ability and skill. Finally, to become board certified a lawyer must pass the Test.

Passing the Board Certification exam is no easy task, in fact it is a grueling exam covering a very vast subject, criminal law, with a very low passage rate. The attorney/applicant must be knowledgeable about every facet of the law. This includes, but is not limited to:

  • 1. Establishment of the Attorney/Client Relationship.

  • 2. Criminal Responsibility: substantive criminal offenses; accomplice, party and conspiracy culpability; culpable mental states; defenses, including jeopardy and statute of limitations; and competency and sanity.

  • 3. Aspects of Criminal Law Prior to Commencement of Formal Proceedings: law of arrest, search and seizure; police interrogation; confessions; and pre-trial identifications.

  • 4. Commencement of Formal Criminal Proceedings: pre-trial release; the role of the grand jury; examining trials and preliminary hearings; charging instruments; venue; joinder and severance; Speedy Trial Acts; and jurisdiction.

  • 5. The Resolution of Criminal Proceedings: pre-trial matters; plea bargains, guilty pleas and grants of immunity; jury and non-jury trials; evidence; sentencing, including federal sentencing guidelines; and capital murder or death penalty cases.

  • 6. Post-Conviction Proceedings: new trials; appeals; post-conviction writs; revocation or adjudication of community supervision probation; pardons and paroles; expunction and non-disclosure; DNA testing; and seizure and forfeiture.

  • 7. Constitutional Law Issues in Criminal Proceedings: right to counsel; right to confrontation, compulsory process, and cross-examination.

  • 8. The Texas Disciplinary Rules of Professional Conduct: the ethics questions cover an array of hypothetical situations which will cover several different aspects of ethical issues that arise in the practice of law.

Knowledge of these and other legal issues are not the sole barometer for establishing Board Certification. The attorney/applicant must have the necessary skill set to communicate with clients, prosecutors, courts, administrative agencies, and the general public. He must be able to analyze both law and fact situations in order to develop effective defense strategies. He must have the ability to both organize and supervise law firm personnel to insure that case investigations and management are conducted properly and professionally.

Finally, to be board certified a lawyer must be peer reviewed by other attorneys, including those he has had dealings with, and judges who are also substantially involved in criminal law and are familiar with the lawyer’s criminal law practice.
