You have a claim against the at fault driver (and potentially a claim against the parent(s) for negligent entrustment). Did your niece in law carry a policy of insurance on the car? Even if you do not carry car insurance, as long as you were driving her car with her permission and she carries insurance, you will be covered under her policy. First, check your auto policy to see if you have any of these three things which would help to get your bills paid: 1. Underinsured motorist 2. Personal injury protection (PIP) 3. Medical payments (medpay).
If any of these things are on your policy you will coverage for his medical up to the limits of the applicable coverage.
If not, then you will have hope the at fault driver was insured and you will make a claim under the drivers liability coverage.
If none of these things are available, you have the option of small claims court (limited recovery available) or filing in state district or county court (probably need an attorney in these courts---although not required). Good luck.
