    As long as you mom's policy does not exclude you as a driver, you should be covered under that policy. However, it sounds like you may have claims against the person who rear ended you. I suggest you consult with an attorney who is Board Certified in Personal Injury Trial Law by the Texas Board of Legal Specialization about your potential claims and your kids' potential claims.     The terms of the fee agreement are contained in the retainer agreement that your wife signed. As others have suggested, a 1/3 fee is pretty standard for a case that is settled pre suit. Good luck.

    Please consult with a Board Certified Personal Injury Trial Lawyer about these issues. Dealing with an insurance adjuster in an 18 wheeler case can be fraught with peril. The insurance company only wants to pay you as little as possible to resolve your claims. Additionally, the answer to your question is yes for a Texas policy.
