  • Can I countersue if I was accused of fraud by workers comp insurance and my job manager?

I was told if I lose I could be arrested. We went to trial and I won. I suffered traumatic stress and have been very worried before I won the case. A manager from my job also lied on the stand stating I said certain things that I never said. In th...

You should contact your workers compensation attorney for specific advice. It is difficult to prove perjury, and since you won your case, the damages are difficult to show. All lawsuits are stressful, and it sounds like you have had enough stress for now.

  • Can an Insurance Company denie a claim when a car is driven by a family member and then subsequently stolen and wrecked?

My girlfriend let her 31 yr old son use her car while she was in Mexico for 5 days. He was staying at a friends and someone stole the car and then wrecked it. She has been making her payments on it, so shouldn't it be covered under her policy?

    Jody’s Answer

Son may be either an additional insured as a member of the household or perhaps even as a permissive user -- or not, depending on your policy language. There would have to be comprehensive coverage to cover the car -- not sure whether collision coverage by itself would be enough. If its a liability only policy, there is likely no coverage. Talk to an attorney in your area who has experience handling insurance cases. They can explain the policy and the law in your jurisdiction.

  • What can I do if the insurance company lied about the amount of coverage the client had?

Someone hit my car & their insurance company told my attorney the insurer had a 15/30 policy. They refused to return calls after several attempts to contact the adjuster. After 8 months of my attorney going back & forth to settle, the insurance co...

    Jody’s Answer

If your insurance company lied, you might have a better chance, but since it was the other guy's insurance company, I think it would be very hard to win. It would also be hard to win, since you did not settle for $15, so damages resulting from the lie are problematic. I agree with the other posters that you should discuss this with your attorney.

  • What can I do if my soon to be ex removes me from health insurance against a court order

I have a court order that states that my husband can not make any changes to his health insurance until our divorce is final. His company also has a copy of this order. He has removed me and his company let him do it. What can be done?

    Jody’s Answer

Let your lawyer know. The court should be informed, and your spouse could be found in contempt for violating a court order.

Get a lawyer who will make a claim against the other drivers and possibly your own insurance for your personal injury and property damage. Good luck.

  • If an appeal was was dismissed because of lack of prosecution can they file for an appeal again?

Thanks in advance for helping clarify for me! Long story short my husband tried to file for joint custody. Before mom was served, she moved states. When she was found and they went to court she said she wasn't moving back, so the judge issued the ...

    Jody’s Answer

If the appeal was dismissed, then it's gone. Generally, one must file appeals within certain time limits, such that a second appeal from the same order that sparked the first appeal would be untimely. I do not practice in Georgia, so I am speaking generally. Of course, in custody matters, something else can come up which would result in another order which could be appealed. But usually, once an appeal is dismissed, it cannot be refiled. You might contact the appeals court clerk to check.

  • My mother's life ins names her five children as beneficiaries. My sister died before my mother. Who gets her share?

Mother died 4/13/16. Sister died 2003. Does my sister's child get her 1/5 share or does it go to the four surviving beothers and sisters?

    Jody’s Answer

Usually, in such a case, the share goes to the deceased's estate. In some cases, and possibly depending on state law, it can go the other way. Ask the insurance company what the policy provides and, if necessary, contact a local attorney to help you.

  • I assigned a claim to a roof contractor and now I want them to stop the claim because i will be selling my home?

    Jody’s Answer

If you received a summons, you need to appear in court. You might want to contact the roofing attorneys again and ask them why they need you to appear, but it might be better if you contact an independent attorney to let you know what the status is and to advise you regarding the summons. Failure to appear when you have been served with a summons can result in bad things happening to you.
