Yes, your case is concluded. It cannot be refiled. Keep the file stamped copy of the dismissal, and other information. If the dismissal shows your name, you should be fine.

From what I understand, you hit a pedestrian. It is likely your fault. Let your insurance company know right away, they can handle any injury claim.

  • In the end, aren't the hospital lawyers hired to protect the hospital; wouldn't it be prudent for me to have my own insurance?

I am an RN practicing in Illinois in a hospital. When I was hired, the hospital told us (the new employees) not to get our own liability insurance. They said, if we had our own and we got into trouble, the hospital lawyers would not be able to hel...

    Jody’s Answer

What do your co-workers do? You might look into getting umbrella coverage over the limits of the hospital coverage, which may be less than primary coverage. Might be a bit tricky, as the hospital coverage will say it won't kick in until after the individual coverage is used up, and the individual (nurse) coverage will say it won't kick in until the hospital policy is used up.

But any lawyer who represents you should have your interests in front of anyone elses. There are some times when there is a divergence between the hospital and the staff -- but it is rare and usually the hospital will be on the hook, anyway.

  • Can I sue her for pain and suffering damages, harassment

I met a man, found out he was married. We have been together for five years. He is still married to her. She does things to hurt me, lost of my job, etc.....

    Jody’s Answer

An Arkansas personal injury attorney can tell you if you have a claim for harassment, defamation, etc. The problem is that a jury may not like the fact you are suing the wife of your boyfriend. But the fact that you are having an affair with her husband is no excuse for illegal acts. Talk to a lawyer and see if you qualify for a protective order, at least.

    Jody’s Answer

If you sue the neighbor, his insurance might cover the claim. But neighbor lawsuits are some of the worst. Check your policy or with your agent to see if your insurance would cover the claim. They can tell you if your rates will increase.
