You're going to want to speak to an attorney in a confidential setting, but when you do, you're going to want to be able to provide the attorney with 1) the date of contact between your husband and the mother, 2) the date of marriage of the mother and her current husband, or if she was married to someone else at the time, the date they were married, and the husband's name if available, 3) whether any other man has claimed to be the father of this child, and 4) is the Oklahoma Department of Human Services involved.

The law is very clear on the topic, however, don't ignore the claim she is making. If ignored, certain legal protections may not be available to your husband. Any attorney familiar with paternity matters should be able to counsel you on the options available to you.

    Good luck.

  • Can child support still be collected after an adoption?

A step parent adoption had been completed on my teen son about six months ago and then the child support was then canceled by DHS. I was divorced ten years ago and I had paid the ex directly myself for a year until she obtained services by DHS and...

You have asked a number of questions that are not easily answered without a review of the records filed within the adoption. Your statement that "child support was then canceled by DHS" raises a number of questions that would need to be answered by a review of your file. If an arrearage existed at the time of the adoption, it may have been addressed at that time. It would be very wise of you to seek counsel and have them review the records surrounding the matter. That would be the only way you will be able to get your questions finally answered to your satisfaction. Good luck.

Child support calculations in Oklahoma are based on a number of factors, including both parties' income and respective overnights with the children. In order to get a better idea of what you should be paying, or what is potentially owed in back child support, you would want a family law attorney to review your existing child support order, with payments made, and calculate current child support based on both parties income, health insurance premiums for the children, number of overnights with the children, and a few other factors specific to your case. An experienced family law attorney should be able to evaluate your situation, get some needed information, and provide the answer specific to your case, in a consultation. You can then decide how you would like to proceed with the matter based on your own cost/benefit analysis. Good luck to you.
