My name is Don Kendall and I have practiced in NW Ar. for 45 years.
Don Kendall has deep roots in Benton County, Arkansas. Don’s family were among the first people to settle in Northwest Arkansas. Eight generations later, the Kendall family still calls this community home. Today, Don and his family of 15 are proud to continue the family traditions of civic participation and community service.
After serving on active duty as an Army infantry officer, Don returned to the area to open his law practice in 1971. In 1975, he with partners acquired one of the region’s oldest businesses, Benton County Abstract Company, where he would serve as president for nearly 30 years while continuing his law practice.
Don gained national exposure as a young attorney while litigating a multistate case during the US savings and loan crisis of the 1980s. During his investigation, Don’s research uncovered information that led to a settlement worth over $8 million. As a result, Don was selected as lead counsel in a complex financial case that produced a $1.7 million verdict in federal court in Tennessee.
After practicing with a larger firm in the early 90s, Don found he worked best when he could spend the time interacting directly with clients; getting to know them and truly listening to their needs and goals. As a result, he once again opened his own practice in Rogers in 1992. This gave Don the opportunity to file one of the largest personal injury cases in Arkansas history. In 1995, Don represented a National Guardsman who received a traumatic brain injury when his car was struck by an 18-wheeler dynamite hauler. Don’s work led to a $5.5 million settlement for his client and the development of a false log auditing procedure.
Don has received high praise from fellow attorneys and judges alike. In a 1998 Arkansas Court of Appeals case, the judge commented: “… [T]his was a truly difficult case. Its difficulty is underscored by the [plaintiffs’] unchallenged testimony that they were searching through attorneys for years before they got Mr. Kendall – before they got someone who was willing to take this case on because it was certainly complex and certainly fraught with possibilities of losing.” The case resulted in a jury verdict for over $200,000.00 and was confirmed on appeal.
In over 50 years of practice, Don has counseled clients in a wide variety of legal areas. He is honored to have earned the trust of his friends and neighbors in Northwest Arkansas.
Don is a member of the Arkansas Trial Lawyers Association, where he has served as President. He is also a Master of the W.B. Putman American Inn of Court.
Don is admitted to practice in Arkansas, the United States District Courts and United States Bankruptcy Courts for the Eastern and Western Districts of Arkansas, and the Eighth Circuit Court of Appeals.
