My case was dismissed shortly after I spoke to Mr. Gapasin and the SAUSA was presented with the circumstances behind my case. I was falsely accused and charged with simple assault after I reported my accuser of cheating on a practical exam and having a video recording of her doing it. Her accusation put my career in jeopardy as CID tried to spin a tap on the shoulder 4 weeks prior into an assault charge.
The Army's overzealous SHARP program fueled her ability to make the accusation against me and made her out to be the victim rather than the subject. Mr. Gapasin was not hesitant to take my case, take on the SHARP program, and the cheater making the false accusation against me.

I was facing UCMJ article 128 assault consummated by battery with two specifications(choking and intent to cause grievous bodily harm). I was facing a special court martial in which the Air Force had given me four weeks to prepare. I called Mr. Gapasin desperate for someone to hear my side of the case and understand. I called many lawyers prior to Ernesto and never got a feeling they had my best interest at heart. My consultation with Mr. Gapasin put my mind at ease. He diligently started working on my case and got me a continuation. Mr. Gapasin would give me as much information as I needed to know but did not over do it. I had faith in him from the beginning. He was understanding of my financial situations, and never once did pressure me for payment. Ernesto worked well with my military appointed lawyer and even flew directly to Japan for my case. He went into my case with confidence and was very aggressive. All in all, Mr. Ernesto reduced my case from a special court martial to a Summary Courts Martial. My charges for assault was dropped to a disorderly conduct and I did not lose my NCO status. If you're looking for a honest, reliable, trustworthy, aggressive lawyer. Ernesto is absolutely the best lawyer in the business. I was involved in a spiteful divorce with another military member who I believed was having an affair. After I notified her command of this and a investigation was launched she accused me of sexual assault and then for 18 months she continued to make up statement after statement against me (giving me more and more charges). Ernesto stood by me every step of the way, fighting tooth and nail against the corruption. He was there when I wanted to give up (and believe me I really, really did more than once). The charges made up against me would have ruined my entire life forever. Ernesto saw through the corruption, believed in me and fought our way to victory and showed the government none of what this woman said ever happened. If I had hired anyone else I believe I would have lost my life. Ernesto literally saved my life against someone who wanted to hurt me in the worst way possible and against a very overbearing and overzealous prosecution. I cannot thank Ernesto enough for standing by and protecting and helping me for the past 18 months. He has given me my life back and I am eternally grateful.

I was being accused of 3 charges which were 1:"without authority absent himself from his unit," 2. "with intent to deceive sign an official document," 3." forgery of a supervisors signature." I went before a Summery Court Martial and was found innocent of both the forgery of a supervisors signature and intentionally signing a official document. Because of such a great outcome Im hopeful now my command will not further any more action against me as I was only found guilty for a minor charge. Because a Summary Court Martial is so unique having Ernesto there to fight on my behalf is the only way that I could have beat 2 out of the 3 charges. Because Im stationed in Okinawa Japan there are no legal defense lawyers here to fight my case for me and I was dependent on calling and learning the laws and rules from a JAG officer stationed over in Korea. Because It was a Summery Court Martial and that there are no military defense lawyers stationed over here in Okinawa Japan for the Army I was being forced to represent myself as the Defense lawyers in Korea were busy doing larger Special Court Martial's in Korea and are not required to represent a soldier in a Summery Court Martial. I was over whelmed with the situation as my command was punishing me administratively as well during this whole time. I talked with Ernesto and he was willing to fly out here to Okinawa Japan and fight my case for me in the Summery Court Martial. I can't tell you enough how grateful I was to him for flying out here from the U.S. and doing all the proceedings on my behalf. If I would have tried to represent myself I would have been found guilty of all the charges as I had no idea of how the military law trials work. Ernesto's willingness to fly out here and represent me has given me a chance to stay in the Army. I have no regrets in hiring him. I did my research on civilian lawyers in trying to find a good lawyer. Ernesto eats, breaths, and sleeps military law. Even if you have several allegations stacked up against you as I had and he is unable to beat them all you can rest assure that with Ernesto you will have a better outcome then if you would have hired anyone else. If i ever get into trouble again while being in the military, Ernesto Gapasin is who I will call. I strongly will recommend Ernesto Gapasin to all my friends if they ever find themselves in any case dealing with Military law.

Ernesto Gapasin worked diligently for two (2) years, until my board and ultimate retention. He was sometimes hard to get ahold of and vague with his answers to my many questions...but ultimately proved his worth at the hearing! You will get discouraged and frustrated along the way, but Mr. Gapasin is your man!!
He is well worth his fee and I highly recommend him.

Mr. Gapasin was determined to make sure I came out of my trial fully acquitted of all charges. He cross examined the governments only witness against me and any other witness they had. Through twelve long hours of back and forth objections with the trial counsel I was fully acquitted of all charges and he proved that the governments only witness was lying. If you need a lawyer that is willing to fight for you to make sure you're given a just trial. Mr. Gapasin is the one for you.

After almost close to two years and a overzealous trial prosecutor. Mr. Gapasin and a determined ADC came into town and defended what was an apparent UCI and prepped/trained witnesses. In the end, all the prepping and lying couldn't save the govt. I was charged with 14 specifications and walked out with 2 meaningless guilty, 1 reprimand, and no confinement.

I, consulted with Mr. Ernesto C. Gapasin Jr. (E.G.) in Aug 2014 about a military case and deadline quickly approaching. E.G. told me his experience and background during our consultation, he resonated with me very well initially. Months later in February 2015, he agreed to take on my case for about half his retainer fee. Unlike a professional, he didn't have a contract or term agreement in place for me (red flag). After receiving $3,000 from me, E.G. avoided my calls for weeks, then months with no status updates (red flag), when i was able to make contact with him he charged me for desiring to know his progress on my case. When i spoke to him over the phone, i also noticed that he was no more competent on my case than before our consultation (red flag). In July 2015, after E.G. seemingly avoided contact with me for 2 months; my fiancee called his receptionist and requested a call back from him. He answered her call swiftly. When questioned about the avoidance of contact with me, E.G. stated, "I've been busy with other clients". Although, he believed my fiancee was a new client and responded swiftly. Furthermore, we got into a debate about what he actually did on my case since being paid. Turns out, E.G. firmly believed that he was paid $3,000 to only do what was done in our initial consultation (to see if this case was trial worthy because that is where he shines), then he stated "I cant help you". I requested a refund of my money to hire an Attorney whom could aid in my defense, and after discovering other military attorney's whom could, E.G. agreed to do the work for an additional $12-15,000 after he had already told me he was not in a position to effectively work. My fiancee filed a BBB complaint because she aided in paying the agreed retainer fee. E.G. called me after witnessing his 16 year sterling reputation at risk of negative client feedback. He then called me, after months of avoidance, and offered to give a refund if she would remove the BBB complaint. After going back and forth about how much should be returned, he responded to the BBB complaint by dishonorably airing Attorney-Client privileged information pertaining to my case in his response to BBB. The BBB then deemed the complaint "out of purview". Then, E.G. after agreeing to refund us, and with my dwindling window for the deadline to petition for a new trial approaching, refused to refund my money. I took this complaint to the Office of Chief Disciplinary Counsel, we are pending their decision later this month. My advice to anyone whom hires Ernesto is 1.) Get all the terms of his service in writing. 2.) Ensure you have an actual trial, which is supposed to be where he "shines". 3.) know that he will use dishonorable acts and his political reputation, instead of his actual performance as your Attorney to shield him should you file a less than stellar complaint about him. Which partially explains his above-average ratings.

Ernesto, was an awesome attorney. I hired Ernesto in May of 2014 and we did not go into court until Nov 23, 2015. Ernesto was professional and engaging the entire time. He was very accessible throughout the long legal process leading to the day of court. He was passionate about my case and I felt like I knew him for years after a short period of time.
On the day of court, he had a plan, but like any good plan - it was subject to change. Ernesto had very impactful opening and closing statements and was very organized and prepared to counter any of the imposing arguments. There were several spontaneous events during the court proceeding to include accessing Face Book for pictures. His keen attention to detail allowed us to maneuver our way through the entire proceedings and make changes as necessary to leave a lasting impact on the board and the court room.
I am very appreciative of his hard work, dedication to his client and hunger for justice.
I highly recommend obtaining him as your attorney in a time of crisis.
Thanks to Ernesto, I am able to continue to serve in the Army and protect this great nation.

After being accused of multiple charges by the Military I knew I had to hire the best. After a lot of research and talking to many lawyers I choose Mr. Gapasin. He was there for me whenever I needed him during my court martial. He fought tooth and nail to prove my innocence of crimes that were collaborated by other soldiers. These charges could have ruined my life and my career. However Mr. Gapasin with his hard charging tactics and experience shown during court. Final outcome was not guilty, I couldn't be happier and thank you Mr. Gapasin for standing by me through all of this. Now I can continue my career and be there for my family all because of you. If you want the best and someone that will put in the extra work then Mr.Gapasin is the right man for you. Thank you again, you have saved my life.
