Brian S. Franciskato is a lifelong resident of the Kansas City, Missouri area. Prior to becoming a partner with the Nash & Franciskato Law Firm, Brian practiced in Springfield and Kansas City, Missouri in the areas of serious personal injury, wrongful death, product liability, employment litigation and commercial litigation. He is licensed to practice in Missouri and Kansas, the United States District Court for the Western District of Missouri and the United States District Court for Kansas. However, he has tried numerous cases throughout the United States, representing individual plaintiffs and large corporations in Missouri, Kansas, Illinois, Iowa, Nebraska, Oklahoma, Tennessee, New York, California, New Jersey, Georgia, Florida, Texas, Arizona, Indiana, Wisconsin, Minnesota, Kentucky Maryland, Washington, Virginia, and Louisiana.
 

Brian attended William Jewel College, graduating summa cum laude in 1990. He graduated law school in 1993 from the University of Missouri-Columbia School of Law. While in law school, Brian served on the Board of Advocates, the National Environmental Law Moot Court Team, and the Missouri Environmental Law and Policy Review. He has received numerous honors for his trial skills, including receiving the Order of the Barristers award given to the top students in trial advocacy and the Fred L. Howard Award for Excellence in Advocacy.

Most recently, Brian has distinguished himself through his work representing individual plaintiffs in serious personal injury, wrongful death,trucking and medical device litigation cases. In 2005, Brian was selected to the Board of Governors for the Missouri Association of Trial Attorneys. Additionally, he is a member of the American Association of Justice (serving as a State Delegate and a Committe Memebr in the products liability and medical device litigation sections), the Orthopedic Device Litigation Group (Member), the Missouri Bar Association (serving on the Civil Practice and Tort Law Committees), the Kansas Bar, and the Kansas City Metropolitan Bar Association (a sustaining member serving on the Solo and Small Firm Practice and Tort Law Committees).

Brian’s accomplishments include being listed by Missouri Lawyers Weekly for obtaining the highest verdicts and settlements. He is routinely called upon to give presentations for other attorneys for Continuing Legal Education, speaking frequently on the practice of civil litigation and evidentiary issues.  Brian is the author of the Missouri Bar Evidence Deskbook: Chapter 20: Scientific Evidence (Mo. Bar Publications 2006, 2010); Plaintiff’s Personal Injury: Statutes That Effect Liability, (NBI, Inc. 2006); and A Practical Guide to Federal Court Rules and Procedures in Kansas, (NBI, Inc. 2003).

Brian is a resident of Lee’s Summit, Missouri with his wife Stacey Mortimer and four children, Emily, Caroline, Claire and Scott. Brian and Stacey are active members in the Lee’s Summit United Methodist Church, serving on the Children’s Ministry Board and assisting the Church in various legal matters.

Brian Scott Franciskato: Best of the Best of the Legal Fraternity
If I had to recommend an attorney to anyone else--friends, family, or acquaintances--it would be Brian Franciskato. In working with Brian for almost three years, I found him to be the most complete legal representative anyone could ask for. His work was meticulous, his replies and explanations were immediate and complete, and his friendly demeanor reinforced his commitment to our lawsuit. We never doubted his determination to succeed or his certainty that he would. Any questions on our part were answered immediately and in detail, with Brian's usual good humor and understanding. We never had occasion to criticize any of his dealings with us or with his goals to resolve our case successfully, which he did. From Day One and my first conversation with Brian, I had complete confidence in his experience, his abilities, and his years of successful representation. And all of this was enhanced by his winning personality and dedication to those he represented. We do not live in Brian's home state of Missouri, but that was never a consideration or a problem for him, or for us. He was even a guest in our home in our introductory meeting. Despite the usual pitfalls over the time frame of the case, Brian never faltered or foresaw a failure. And in the long run, he did as he had promised when he achieved an entirely suitable settlement. When our case closed, it was capped by an exchange of mutual respect and goodwill. If a situation was ever to arise that required legal representation again, I would not settle for any attorney other than Brian Franciskato.

Wonderful experience
We had never hired or had need of a lawyer before and we were scared. You always hear such negative things about lawyers and their character. We met with Brian and all our fears were gone. He was helpful and thorough and made us feel comfortable right from the start. He is personable and informative and always kept us up to date with everything that was going on. My husband has a very varied work schedule and Brian would always work around it. Sometimes even calling after 9 pm from home. He was always there when we needed him, and never complained that I called too much! He got us a lot more money than we expected and we never even had to go to court!
