    As all have noted, hearsay. This gives law students and lawyers trouble all the time. Just get a witness that saw you at work to come testify.

    Based upon the conviction, it is going to be difficult of not impossible to get a FOID card. You need to apply for one first, have it denied, then bring a suit. Depending upon the disposition of the old case, supervision, etc, as suggested above you could try to expunge, but that may also be a non-starter.

    Section 1983 allows you to being a case against the police for violations of your constitutional rights. It is not a violation of Section 1983, that is just the statute to allow a private citizen to sue the government. You need to contact a civil rights attorney.

    There are numerous attorneys that handle civil rights cases in Illinois and Indiana. If you are looking for new counsel, there are a few questions you will be asked. When was your case filed? How much work has been done? Is it in federal court or state court? Has your doctor issued an expert report about your future damages and expenses? Etc.

    Notably, if this is a section 1983 case (not just state claims), the attorneys can get their attorneys fees separate from any jury award (if contract is written that way) under section 1988 should they prevail at trial or win judgment another way (offer of judgment or summary judgment). If your case resolves with just a settlement, most likely it will be a lump sum that includes the attorneys fees. The fees will be taken at the percentage agreed upon in the contract.

    Making a complaint internally is your best bet. Maybe they will investigate, maybe they will not. You could also try the Illinois State Police, but they most likely will tell you file file the complaint with the department. Make sure to document the harassment and be speedo I with your complaint. If the harassment persists, you may have a claim against the officer under a class of one theory. Yes there are immunities, but an attorney that handles civil rights cases knows how defend against that defense.

    You are lucky your attorney is willing to cut the fee you agreed to when you signed a contract with them. Some attorneys will stick with he 1/3 or only reduce as required by statute when reducing liens.

    You need to decide if the settlement offer is fair or if you need to continue to litigate and see if the $35,000 will go up.

    You can claim emotional distress without seeing a doctor or even having a physical injury. However, the defense will challenge your emotional distress and not being serious since you did not seek professional help.
