What he can and should do is hire a lawyer to defend this. If he didn't admit to it and he only tested at .01, it might be low enough to be thrown out on that basis combined with other circumstances. Your lawyer undoubtedly is working on liens and amounts of medical that must be paid back out of any settlement. Further, if you have no health insurance, then your options are limited. If you do have health insurance, I'd use that for any additional surgery while waiting for the case to settle.

But I do have to say your allegations seem broad and not provable. Nothing you've written seems to indicate misconduct. Results you didn't want, but not attorney legal malpractice or unethical behavior without more.
Be very careful before you make scattershot allegations against someone that may result in them losing their livelihood. I would suggest a sit down meeting to better understand what happened and why.
