  • Can I still use my $100,000 uninsured coverage?

I was injured in a car accident and need surgery on my wrist. I was hit by an uninsured driver and I wanted to use my uninsured coverage. I was at fault in the accident (ran a stop sign).

    David’s Answer

Absent some reason why you ran the stop sign, your insurance company will deny coverage.

  • Is my ex responsible for additional bills if she chooses to change her insurance for the kids during a ortho treatment?

If my ex changes her insurance (which she is required to carry for the kids) in the middle of ortho treatment, which then results in additional money being owed would she be responsible for that? I have already paid what was originally agreed on!

    David’s Answer

It would depend on the reason the to change in insurance. If her employer switched plans, then probably not. However, if she changed her insurance on her own, then discuss with your divorce attorney.

    Good luck.

    David’s Answer

You need to have your mother;s insurance policy examined by an attorney that is experienced with insurance bad faith cases. Your mother's insurance company owes her a good faith duty to investigate and pay her claim. Anything short of that could constitute bad faith, which opens up the insurance company to money damages.

    Good luck.

  • Can I get the other insurance company to cover the loss of my car.

MVA on 3/6/2016. Other party ran red light. Insurance company not doing much. I need another car and would like to be reimbursed for damages.

Contact your insurance company and get them on board. Let them deal with the other insurance company, that's why you pay your premiums.

I agree with the other attorneys. Your husband either had your permission or he didn't. If he didn't then your insurance will deny the claim and the other person's insurance will pay the claim and go after your husband.
