  • Can we submit documentation to the court for settlement approval instead of having the ins. company's law firm do it?

16 year old receiving insurance settlement for personal injury. No lawsuits were filed. No attorneys were involved.

    David’s Answer

They are doing what is called a minor settlement hearing in which the judge will agree or disagree with the settlement. If the judge agrees then he/she will order the funds be held in a restricted account so that mom and dad don't spend the money before the child turns 18. These are very simple hearings.

The insurance company will have an attorney handle the proceeding at no charge to you, and file all the necessary paperwork. All you have to do is show up with your child and answer the judges/attorneys questions. The insurance company is just doing this to protect themselves from situations where the parents spend all the child's money and the child could then sue the insurance company for not protecting their funds.

    Good luck.

    David’s Answer

Before any worker's comp attorney can assist you, they woudl need to know if any doctor supports your theory that exposure to chemicals at work has caused your ailments. Without such medical support your claim will not only be denied, but there is not much an attorney can do to help you.
