  • Is my court appointed attorney helping? What can i or my boyfriend do to change him?

My boyfriend is in county jail being held by the marshals, he is being charged with conspiracy, possession with intent to deliver and distribution of a controlled substance, he sold a pound of meth to a cop and was cough with 5 more and they have ...

    Priscilla’s Answer

The only recourse for your boyfriend if he wants a new appointed lawyer would be to write a letter to the judge and ask for a new lawyer. He should not discuss any of the fact of the case in the letter just the issue with his lawyer. There is no guarantee that the judge will appoint a different lawyer, and often times, the judge will not do so. Also, your boyfriend is the client and the lawyer has no duty or obligation to speak with you about his case. In fact, without specific authorization, the attorney can not speak to you about your boyfriend's case and if you are a codefendant and have your own lawyer, your boyfriend's lawyer cannot speak to you without your lawyer's consent.

  • Failed 2 drug test missed 1

I am on probation for 2nd dui i failed 2 test for marijuanna and missed 1 i have already had my probation terminated and reinstated and spent two days in jail what will happen now

    Priscilla’s Answer

A missed test is usually presumed to be another positive test for drugs. It is likely you will face more jail or prison time. You should consult with a criminal defense or DUI attorney who practices in the court you will be appearing in as they can give you a better idea of what happens locally

  • I had a owi 9 years ago in Illinois but had a discharge and now in the same state so how do work out.So what is the difference

So what is the difference between discharged and dismissed in the court system.

    Priscilla’s Answer

I would have to look at the documents, but often times discharged means you completed the sentence and dismissed means that the prosecutor withdrew the charge against you. Criminal laws vary from state to state so you would need to talk to a lawyer in Illinois to get a more definitive answer

Immigration form I-130 requires G-325A form to be accompanied for both petitioner and his spouse. In G-325A form it asks for applicant's address etc. Since both petitioner and his spouse need to have their own G-325A form, is the USCIS considering...

    Priscilla’s Answer

The G-325A doesn't specify "applicant" so no, they aren't considering both to be applicants. They are asking for the background information on the Petitioner and on the Beneficiary. It's just part of the process

  • Are license plates run randomly on a routine basis?

Do police regularly run license plates to check the status of the registered owner (suspensions, warrants, etc.), or is this done only if a traffic offense has been committed? Thank you.

    Priscilla’s Answer

Yes, and there are some areas with license plate readers that read plates without an officer having to call them in to check them.

    Simple misdemeanor.

    Priscilla’s Answer

I agree with the others answering this question but would add, if you are an immigrant be aware that a deferred judgment in Iowa is still a conviction for immigration purposes even if it has been expunged
