If you've had three BAIID failures, I suspect you are shortly going to receive notice of a re-revocation, as they are considered major violations. You'll need to request a hearing with regard to the violations, and you've got to have a pretty good explanation (that doesn't involve YOU having drank alcohol) for why the BAIID indicates that there was alcohol present. This isn't going to be a matter of when to apply for a full license - it's going to be about whether or not you get to keep your current restricted one. You may have a condition of probation, however, that prevents you from having contact with felons. Given that this is your first offense, you are eligible for two different deferral programs. One is the Holmes Youthful Trainee Act (HYTA), and one is a deferral under MCL 333.7411. (7411) Your eligibility for HYTA is based on your age, and the deferral under 7411 is based on the nature of the crime.
If you are placed on probation under either deferral, you will not have a conviction on your record, provided that you successfully complete the terms of your probation. While you can still be placed in jail under either deferral, jail time is generally unlikely in most courts for a first offense. Either deferral also prevents the 6-month driver's license suspension from being imposed. 7411 can only be granted once in a lifetime, so HYTA is the preferred deferral, so that you can retain the ability to get 7411 later, if necessary.
It would be wise to hire an attorney to explore whether the deferral is the right solution for you, or whether there is a basis to fight the charge.See question
