Description: Plaintiff was traveling westbound on Interstate 94 as a passenger in a sports utility vehicle, at which time the SUV lost a tire. The driver negotiated the SUV to the side of the road, leaving a small portion of the SUV in the travel portion of the roadway. Several passengers exited the vehicle and were standing on the shoulder, at which time a bus, owned and operated by the City of Detroit, struck the vehicle as well as hitting pedestrians on the side of the road. A wrongful death suit was filed against bothe the drive and the City's department of transportation.
