Hi I applied for lgbt asylum 4 years ago and im still in pending and if i marry opposier sex which is we are together for 1 year Can i still apply for green card ? Thank you

    Mani’s Answer

Huge ref flags will pop up, and this will likely not end well. If you are bisexual and the marriage is legitimate, this will still be an uphill battle. Setup a private consultation with an experienced immigration attorney that has dealt with similar issues in the past to determine the best path forward.

  • Can you travel to the country where you sough asylum from when your AS6 category green card is granted?

Im applying for political asylum from India based on fear of persecution/discrimination based on current law and want to know if I could travel back to India freely when my AS6 category green card is granted? or will I have to still apply for adva...

    Mani’s Answer

In order to win an asylum, one of the many things you must prove is you have a subjective fear of persecution in India base on an objective standard. This means you must actually fear returning to India, and not willing to freely travel to India, and a reasonable person in your situation would also fear returnin persecution if they returned to India. If you are willing to travel back to India, then you likely do not qualify for asylum as you will not be able to prove a subjective fear of persecution based on an objective standard. If you travel back to India after gaining a green card based on asylum, then you could lose your green card depending on the country conditions at that time of your travel. In addition, the persecution you fear must be due to your race, religion, nationality, political opinion, or your membership in particular social group. Meet with a good immigration attorney to review the risks associated with filing an asylum application and the strength of your case before filing an application with the government. • If I applied for asylum, the government would deport me? Please help! Thanks.

Hello, I came to US as a child with my mother without border inspection (border jumped) couple of years ago. Can I apply for asylum now? If I applied for asylum, the government would deport me?

    Mani’s Answer

You need to meet with a good immigration attorney to determine the best path forward. Asylum claims are very difficult to prove, especially if you do not have an attorney familiar with asylum law assisting you. If you file an asylum application and it is not approved, then you could be deported. If you arrived to the U.S. as a child you may qualify for DACA, which would defer deportation, and make you eligible for a work permit. After receiving the work permit you can obtain a social security card and drivers license. Avvo is a great place to start your search for an attorney. To avoid deportation, do not file any applications with the government without first meeting with a a good immigration attorney.
