How to expunge? 1989 drug charge, possession with intent to sell.
First we have to see if you are eligible. Since it is a felony, there must be only one count and you can have no more than 2 other misdemeanors and 0 other felonies in your life time. If this is true, you must file MC 227, or make a motion to set aside a conviction. You must file the motion with the court, prosecutor, Attorney General and Michigan State Police. With the Michigan State Police, you must also include a $50 fee and copy of your fingerprints.
You must wait until the MSP and AG both respond to the court before having your hearing. Then at the hearing if the Judge agrees to set aside the conviction, you will get an order setting aside conviction. That order must be sent to the Michigan State Police.
At this point only 1/2 of the work is done. The second half is making sure it comes off all of the public database background check companies. SOME attorneys who do a lot of expungements (myself included) have large lists of these companies and can notify several of them at once when you are done. This may be included in the fee for helping with the expungement.
