You can petition for a guardianship. You would have to retain a lawyer for that. If you think that your nephew is in grave danger, you can contact CPS and they may open a CHINS action if it rises to that level. Keep in mind, if you contact CPS, while helpful if you think the child is in real danger, can create other problems. It might be best to approach the subject with them and see if they will voluntarily consent to a guardianship. If they consent, that will save a lot of time and money for a variety of reasons. If the protective order is against you, you're actually in violation for communications if they are against the protective order (in other words, you're not permitted to respond or talk on the phone and you respond via text or pick up the phone and talk). She needs to file formally with the court to either dismiss the protective order or modify it so these types of communications are permitted.
