Horvath v. Lawyers Title Ins. Corp., 2013-Ohio-1295 | Summary judgment for the title insurance company was affirmed. There was no evidence in the record to support a finding of bad faith. Court also found that escrow functions are outside of the scope of agency for a title insurance agency agreement. |
Albert M. Higley Co. v. N/S Corp., 445 F.3d 861, 863 (6th Cir. 2006) | This case upheld the right of a party to a construction contract to reserve sole discretion whether to proceed with arbitration or litigation. |
