    It varies from state to state, but in most states any of the children can file. But that does not mean they have exclusive right to suit proceeds.

    I think you need to wait and see how your son is affected by this incident before you make any decisions about whether to pursue a civil claim for pain and suffering. And, in my mind, whether you choose to pursue criminal prosecution should not be determined by whether they compensate your son for his pain.

    You can always represent yourself and you will not have to pay an attorney fee. There are books you can buy that outline the process of handling a claim. And there is a law library where you an go research the applicable law.

    Or you can hire an attorney and have him/her handle it. That is not free, nor should it be.

    Yes, you should engage a lawyer. As a patient, your mother has a right to be free from sexual assaults. Further, the hospital has a duty to protect your mother from known dangers such as the one you described.
