    Depends. Since you have been letting her see him more often she may get an order for more visitation. You can tell her you are going to counter petition or even tell her that you are considering petitioning for Rule Nisi for Contempt for her non payment of child support. It's hard but not impossible to get custody reversed. She's not in a very good position to get custody when she hasn't been paying child support. I would argue if she can't help support a child she sure can't take care of the child. There are many factors to take into consideration when considering this. For example if you were doing drugs, drinking and driving with your son in the vehicle, living on the street with no home, or doing something else illegal then you could loose custody.

    See if they have a legal services or volunteer lawyers around you to help with this. You can really mess yourself up trying to do this by yourself trying to get it for free. Bankruptcy is not something to file without knowledge of that law.

    Here in Alabama we could file a composition case and you could pay what you could afford. They will be still owed when you get through but at least it will get them off of you. Go see a bankruptcy attorney in your area immediately to keep from being garnished.

    I have been told not to have more than three store cards and never have more than 1/2 the balance charged to have the best effect on your credit. I'd keep charging and keep paying them in full personally.

    I have seen judges dismiss bankruptcy cases for people that were behind in their mortgage at the end of the chapter 13 case. My advise is to try to get a loan modification approved now or like the other attorney said get a family member to help you catch up. I have seen this several times that someone could get months and months behind and the creditors fail to act. About 1/2 the time the creditors will contact us and eventually file a motion for relief from stay if the debtors don't catch up. Don't sit back and do nothing.

    I agree that if u can get the police to go with you go. Getting your lawyer to send her lawyer a letter is another remedy and taking her to court for a rule nisi for not obeying the court order if those two things don't work is next.

    If you haven't paid on this debt since 1986 it may be too old to collect. Make an appointment to go see a bankruptcy or a fair debt or collection attorney in your area before doing anything else.
