Description: Ms. Phillips was walking on the sidewalk in Birmingham, Alabama. Her foot caught an area which had been repaired improperly. When she fell, she broke her arm which required surgery and an external fixator. The City would not offer her a dime so we had to try the case. It was clear from the depositions and testimony of the witnesses that this sidewalk had been a problem, and they attempted a repair instead of replacing it. The repair masked the height difference so you could not see the uneven portion which is what caused Ms. Phillips' fall.
