Description: This was a defamation action by a lawyer who served as a Personal Representative of a Florida probate estate against a nephew of the decedent who had attacked the Plaintiff through Bar complaints, removal actions, criminal complaints and, finally, through newspaper articles claiming the lawyer was seeking to deny the nephew his inheritance. At trial the jury found the Defendant had maliciously defamed the Plaintiff causing him loss of reputation and mental pain and suffering and that the Defendant's actions were the product of seeking financial gain. The trial lasted 3 and 1/2 weeks in Federal Court in Ft Myers, FL. The verdict was reduced by remittitur to $500,000 by the trial judge and affirmed by the 11th Circuit Court of Appeals.
