My landlord initiated an eviction on 7/26/13 claiming that I have not paid rent for 3 months. We received a discount for paying rent in cash to the landlord and conveniently he did not have his receipt book. Basically I have no way to prove that I...
I am not sure why you needed a receipt from a "receipt book" when a handwritten receipt would have sufficed to prove that you paid the rent. You did this for three months to get a discount?
Yes. Until the gavel comes down and the new title owner is registered, the owner is the owner and rent is due.
I am working with BOA to do a Modification but their Lawyers requested the judge to reset a Foreclosure day for my property. I am at the beginning of Modification. Still collecting paperwork. Today August 21, 2013 , at 1PM I have a Hearing in fron...
I am hoping that you were successful in having a new date for a foreclosure hearing so that the modification can hopefully go forward successfully. I do not understand how you paid for three years as part of a chapter 13 and then BOA raised your payment. Under 13, you have been required to pay the past due amount and the mortgage payment going forward.
I would suggest you consult with an attorney who could help you unravel your situation and hopefully move the case forward to a successful conclusion.See question
my lawyer does not want to settle my case as it is stated on my settlement agreement
I do not know what type of case you have mediated or whether you attorney was with you during the mediation. I have attached a link below for the 8th Circuit, simply because it states that if your lawyer does not attend mediation with you, you have ten days to have your lawyer review the agreement. I am not taking a position in any manner, simply giving you information on the possibility that if it was a family mediatied agreement and if your lawyer did not attend. Meanwhile, why aren't you asking your attorney these questions?.See question

If you haven't paid your mortgage in six years and one month, there is a good argument to be made by the bank that every month the new amount due is different and the Liam re-accelerates after proper demand and notice.See question

I agree with the other attorneys and she should call the police if he locks her out again or does anything abusive, emotional or physical, while she's waiting to get out of the relationship. Knock on a neighbor's door and call the police!See question

Please consult with a foreclosure/bankruptcy attorney. HOA judgments are personal debt and the foreclosure might have covered/satisfied the HOA fees, but then you are paying a mortgage for a property you no longer own.See question
