Description: The trial court granted summary judgment against my client, Mr. Brock, and awarded Yale a security interest on the entirety of his house after his (now ex) wife forged a deed in order to refinance the mortgage and cash out equity in the marital house. On appeal, the Georgia Supreme Court reversed the trial court and held that Yale could not acquire a security interest in the entire property as a bona fide purchaser because the deed was forged. The Georgia Supreme Court overruled two earlier cases in order to reach a favorable result for Mr. Brock.
