  • Is the return of warrant issued after the warrant has been issued?

Is the return of warrant issued after the search warrant?

    Kimani’s Answer

Yes. Usually a return of warrant is referring to the document that is filed after the law enforcement officers have searched whatever is described in the search warrant. • I got cited for 40-5-20(A) , i am really frightened , can i face jail time?

i have valid WI driving license , but not aware that i have to have GA license in 30 days of moving, my wife is here and I spend lots of time here, when officer asked i told i spent last three months here, so he cited me this , i am really scared ...

    Kimani’s Answer

Any traffic offense in Georgia has a possible penalty of jail time. However, most offenses, including 40-5-20, will be resolved with simply a fine unless you are a serious repeat offender. Regarding your situation, you may want to hire an attorney. An attorney could possibly negotiate with the prosecutor to have the charge reduced to a lower charge which would impose a lower penalty. Also, if you plan to remain in Georgia, I would advise you to get the Georgia license which would show the prosecutor you took corrective action of the situation.

  • I rented a room in a house and the power and water got cut off. What can I do?

Been renting a room in a house for over 3 months when suddenly an eviction notice for my landlady was served,.followed by the lights and water Being cut off. What legal actions can I Take?

    Kimani’s Answer

I do not believe that it will be worth while to take any action against the person renting you the room. That person may not even have had the right to rent you that room. Nevertheless, to take action against the person who rented you the room, when that person clearly doesn't have the money to pay rent or utilities would most likely be a waste of your time. How would that person be able to pay back rent, back utilities and pay you for your troubles? it is unlikely. Best advice would be to figure out a easy way to move on.

  • What the difference between the certificate of warrant and the search warrant?

Can there be any different evidence in the certificate of warrant and the search warrant in the discovery package?

    Kimani’s Answer

First of all, it is difficult to know precisely what you are asking with this question. However, many people refer to the certificate of warrant as the certification given to the warrant by the clerk's office who certifies that it is the true and accurate warrant that was used in order to enforce a search. The search warrant is the document that indicates what is to be searched and to what extent. This document is signed by a judge who is representing that he/she believes there is probable cause to search whatever the item or location that is described in the search warrant. Therefore to answer the question, the search warrant is one thing and the certificate is most likely a document or part of the search warrant document certifying that the warrant is a true and correct copy.

  • Can I go to jail?

I was arrested for retail theft under $10. It is my first offense and I am 19. What are some of the consequeces I may face?

    Kimani’s Answer

Every jurisdiction is different. Therefore, the possibilities vary. However, in your situation the most common result is some sort of diversion program or fine and maybe some community service. I do recommend hiring a lawyer to negotiate on your behalf, but first offender shoplifters almost never go to jail.
