What a nightmare. I am sorry that this happened to you. Yes, you can most likely sue her. The insurance coverage would need to be sorted out first, which is an easy process. You need an attorney that handles these type of cases, is familiar either professionally and/or personally with back injuries & one that is prepared to try the case, if necessary. I'd recommend trying to find someone who is attentive, empathetic & assertive. Best wishes & I hope you feel better. :-)

    Sam’s Answer

The other attorneys who commented are exactly correct. Talk it out /w your attorney. If he/she is not willing and if you have lost confidence in him, you need to find another attorney. Myself & others on this forum are fully competent & capable to assist you, BUT, you need to be vulnerable, authentic & totally honest with your current attorney & tell him how you really feel. Do that first & best wishes.

An attorney should be able to assist you in trying to resolve your claims & then filing a lawsuit, if necessary. You should talk with an experienced attorney in your area--either myself or someone else. Best wishes & good luck.
