  • Under what circumstances can I have my criminal record expunged in the State of Georgia?

I recently pled guilty to, and was convicted of three misdemeanor charges in the State of Georgia. My attorney and I were able to obtain a plea deal from the prosecuting attorney, and I was assessed fines, as well as probation. A friend of mine ...

    Noah’s Answer

Generally a conviction cannot be restricted/expunged/seal. There are certain exceptions for misdemeanor offenses (after five years) if you were under the age of 21 at the time of your plea. Also, if you entered your plea under the first offender act, and successfully complete your probation, then the conviction will be discharged. You should discuss your case in detail with the lawyer who helped you with your case.

  • Can a passenger of my wife's accident sue us?

Hi, my spouse got her first car a few months ago and had a major car accident with a motorcyclist not long after. She had 4 passengers in her vehicle that all had minor injuries during the wreck. My spouse was charged with a felony DUI but thi...

    Noah’s Answer

Yes, a passenger can file a lawsuit against your wife since she was the driver of the car. Whether the passenger will recover any money depends on wether the accident was your wife's fault and whether the passenger was injured. Regardless, your insurance company will defend your wife and provide her with a lawyer.

  • Is it legal for a 16 year old to have sex with 25 year old?

Is it legal for a 16 year old female to have sex with a 25 year old male if she consents? Thanks in advance. I'm asking for a friend.

    Noah’s Answer

While the age of consent is 16 in the state of Georgia, and therefore it is not illegal to have consensual sex with a 16-year-old, it would be incredibly stupid for a 25-year-old to have sex with a 16-year-old. Additionally there are other laws they could be violated from a 16-year-old and a 25-year-old having a relationship.

  • Can a felon be charged with a gun or drugs if they were not in his possession.

My boyfriend was at his friends house when the police had a search warrant for his friend. His friend came forward and turned himself in. The police then arrested my boyfriend for I guess being there while on state probation. After he was gone the...

    Noah’s Answer

The police can arrest you for anything. Whether the State will formally charge him is another question. That being said, it is a violation of his probation to be with people who commit crimes and at a place where there are drugs and guns. Obviously he needs a lawyer to help with the new charges and the probation revocation that will be coming.

It would depend on whether the initial charge had anything to do with sexual conduct against a victim who is a minor. What was the basis for the cruelty charge?

  • I wanna know if I can get my case back into court and Sue?

    Noah’s Answer

I am sorry, but you gave up your rights to contest the illegal entry into your house when you entered your guilty plea. It sounds like you had a very good case to fight and should have done so instead of waiving your rights and entering a plea.

  • Is the Romeo and Juliet Law retroactive?

My husband was convicted of child molestation when he was 19. The girl he was with was 15 and they only partook in oral sex and it was consensual . Both were still in high school. He is currently on probation and will not be released from it until...

    Noah’s Answer

Sorry, but the law is not retroactive. That being said, assuming he's been doing well in probation, I would consider hiring a lawyer to file a motion to terminate his probation. Once probation is terminated, and depending on his classification by the sexual offender registration review board, it may be possible to have him removed from the registry. This is not something he wants to try to do without a lawyer and make sure your lawyer has experience with getting people removed from the registry.
