  • I was charged with an infraction in a juvenile court and was wondering if this will show up on any kind of background checks?

Also, should I get my record sealed?

    Lisa’s Answer

For employment background checks, this shouldn't show up. For law enforcement purposes, it can.

  • What happens to a runaway juvenile who has a charge when they turn 18?

The juvenile has been charged with a class A misdemeanor for possession in a drug free zone. He has runaway and wont attend court or school and has a violation of probation warrant for having runaway. Say the kid survives with out getting arrested...

    Lisa’s Answer

You really need to contact a lawyer. It is unclear what age the juvenile was when he was charged with possession. In GA the statute of limitations runs if the case hasn't been accused, do you know if the case was accused? There are many facts an attorney needs to know that simply can't be answered by an on-line general answer.

  • If a witness in a court case is asked to identify a suspect and can't, what is suppose to happen?

witness said she didn't know and then asked someone who while still on the stand.

If that person truly cannot identify a suspect, there will be no repercussions. The only requirement is that person not perjure themselves on the stand and that won't happen if they tell the whole truth.

    Lisa’s Answer

Definitely talk to an attorney in CA that knows CA criminal laws. A good attorney should be able to help you tremendously in this case if this is exactly what happened. Hopefully, your wife will not report you as it sounds like your wife overreacted.

  • What will happen when i go to JUVENILE court?

im a juvenile and i have a theft by taking, criminal attempt burglary, & Shoplifting pellet guns. what will my consequences be when i go to court.

    Lisa’s Answer

It really depends on very specific facts of your case. (Talk privately with an attorney about those.) Even though you may only be a juvenile, these are pretty serious charges and even though juvenile court is very interested in rehabilitation rather than punishment, you need to make sure you have a good lawyer. If your parents cannot afford to hire a good private attorney for you, you should be able to get a court appointed lawyer. Good luck to you!!

  • How long can someone get in jail for committing the same crime as a minor if they didn't seal their juvenile records?Petty Theft

how long can someone get if they had a petty theft charge as a minor, and did not seal their juvenile records after 18, and committed the same crime at age 18 ? Can they use those records against them still? even after doing time as a minor for it?

    Lisa’s Answer

You should contact a criminal defense lawyer in CA to find out what the punishment will be. Your criminal record is usually looked at by the prosecutor when assessing your case. Sometimes they do not see your juvenile record but I wouldn't count on that. In Georgia, you are considered an adult at 17 for criminal charge purposes. Again, contact a CA criminal defense lawyer to make sure you get an answer that reflects your state's laws.

  • What evidence does the courts have to have exactly to charge someone with trafficking charges when they didn't find nothing

Prior 2 trafficking charges and catching a burglary 3rd on bond on them 2 trafficking charges and now trying to charge him with 2 more trafficking charges

    Lisa’s Answer

The state is required to prove your case beyond a reasonable doubt. They can do that with direct evidence or circumstantial evidence. This charge is very serious and you must hire a lawyer to help you with your case. If they make an arrest, at a minimum, they believe they have probable cause. Good luck!

    Lisa’s Answer

It will show up as an arrest but since your case has not been adjudicated, it should not show as a conviction. Upon successful completion of the conditions of your sentence, it should not show up as a guilty plea or a conviction! Stay the course and good luck!!

    Lisa’s Answer

You really need a lawyer to represent you rather "explain to the court your situation". Anything you say in court or to an investigator may be used against you. A lawyer is skilled and experienced and knows how to fight the charges without digging a deeper hole for you. Unfortunately, a conviction could affect your immigration status.

No good deed goes unpunished. I am so sorry to hear about this situation. You may want to hire an attorney to help you with the conflict and with the charge. I would think many of us would be very sympathetic and would charge you a reasonable fee.

    Best of luck to you,
