McNamee v. A.J.W., 238 Ga. App. 534, 519 S.E.2d 298 (1999);

Case Conclusion Date: 01.01.1999

Practice Area: Litigation

Outcome: Summary Judgment on Remand

Description: Obtained a reversal of the trial court's denial of our motion for summary judgment. The Court of Appeals held that there was insufficient evidence to hold parents responsible for wrongful supervision of their son's actions where there was no evidence of prior similar activities. The Court of Appeals also held that the defendant in a civil claim for sexual battery can use consent as a defense even where both parties involved were under the age of 17 and consent could not be used as a defense to a criminal statutory rape charge.
