Description: Linton was on the side of the road urinating when the police pulled up. He was given field sobriety evaluations which he failed. He was give not given a breath test as he refused. The officer never saw him driving and the case went to trial. We had an affidavit from a friend who was in the military. The friend named Chad was deployed to Iraq and he swore he was the driver. Linton testified at trial that Chad was driving. The jury found Linton not guilty. Linton was facing considerable jail time as it was his second DUI in the last 5 years and the third in his life.
