McCoy was cold called by a home improvement contractor who knew she had substantial equity in her small home seeking to do home remodeling for her. He arranged the financing. He started the work but never completed it and what was done was "less than tree house quality." MCCoy was out of her home 3 years while the work was never done. We sued Sargent for the defective work and to recover the payments he had obtained. Consumer purchased used Dodge from a local dealrship. She specifically asked the salesman if it had been wrecked. She was told no. She hd an issue with the car and took it to the Dodge dealership for repairs under the Dodge Factory warranty. Dodge refused the repairsaying the car had been wrecked. The car had in fact been wrecked and was traded to the selling dealer in its wrecked state.
