State v. K.E.

Practice Area: DUI and DWI

Outcome: Not Guilty

Description: This gentleman was stopped by a Coweta County deputy sheriff near Newnan, Georgia, when he turned into eastbound traffic lanes while traveling westbound. He quickly drove his rental car over the median into the westbound lanes but not before the deputy stopped him. We framed the issue as whether it was that unusual for a person to turn the wrong way down a one-way street when he was in a town with which he was not familiar. We introduced this theme during voir dire and continued it throughout the trial. We called as a witness for the defense a man who had been a passenger in the defendant;'s car on the evening of the arrest and who had also made the same mistake at the same intersection. The jury asked to see the video again during deliberations, and about an hour later returned a verdict of not guilty on the DUI, reckless driving, and a lesser traffic offense.
