  • If a person is 100% disabled by military would they be able to keep temporary guardianship of a child, and for how long?

    I went to jail so I gave custody to my dad. Ive been out almost 2 years now all of a sudden I get call saying he put my wife in jail for kidnapping. He more or less holds her over my head. I need some options please.

    Go to Probate Court sand try to terminate, or "undo", the temporary guardianship of the child. They have forms to do that, already printed up so that you can fill-in-the-blanks. There is a difference between custody and guardianship, so you might want to get an attorney involved to make sure you've got all bases covered.

    No, the deadline is your birthday. If it makes you feel any better, I received such a ticket two days after my birthday. Those automatic tag readers are killers!

    The best you can do is get your tag paid up ASAP and bring the receipt to court with you. Hopefully they will reduce the fine or dismiss the ticket entirely.

    Contact the Court and ask. Georgia law changed last November and his case could not extend over 12 months- your husband might have benefited from that. However, he probably still needs to pay, or his license may be suspended. Check online at DDS.ga to see if its still valid. If paying money can resolve the situation or allay his fears, do that. Call a lawyer if this doesn't help.

    First, pleading guilty to ANY criminal offense will in no way improve your immigration status. And just because an officer is no longer employed with an agency does not mean that he/she is not available to testify if need be. But if you want to even TRY to withdraw your guilty plea, you need to do it within 30 days of the date of your plea. Even then, you need to show that the plea was not voluntary and that it was uninformed or that other things were unknown to you.

    So, thinking about it even a few days can prevent you from even being able to try to withdraw the plea.

    So, get a lawyer ASAP and file something, and work out the details of how you will succeed with your lawyer.

    Yes, you need a lawyer, because a charge like this can send you to jail for a few days, get you on probation for a year, AND suspend your license. Besides, there are ways to get this ticket reduced very easily, with a lower fine and no suspension issues. Its worth it to hire a lawyer. Good luck.

    The ticket is valid, but the information regarding the wrong motorcycle can be an indication that the officer pulled over the wrong bike. If that defense has merit, consider hiring an attorney to help you with the case. Good luck.

    The law in Indiana will control, so you ought to post this question there. But generally, you can file a petition to become a guardian or a Conservator, or both, in the Probate Court in the County where she lives. If you have any siblings, they will have to be involved, one way or another. If you want to be name as Guardian, you will have to have her live with or near you, but maybe with the Aunt, you can be a co-guardian.
    Once you get things filed in Court, all the information you seek will need to be disclosed to the Court so it can make an informed decision.

They have forms for you to use to "recind" or "Undo" a Temporary Guardianship. Go get those forms, fill them out and and file them (there is usually some sort of filing fee) and then you will have your day in Court. Good luck!

    Yes. But do things in this order: Get insurance on your car; drive to court or a lawyer and show the insurance card. Things will get better from that point.
