  • What should we do in order to pursue a medical malpractice suit following a stroke?

I suffered a stroke but have none of the conditions or behaviors leading to it. The doctors have determined the cause was probably estrogen replacement since I was on both a psych and a vaginal ring. They determined that that the dosage was too hi...

    Bruce’s Answer

In addition to the prior answer, have someone review the mix of medications that you were taking. An improperly prescribed medication could also cause a stroke. You should seek out qualified counsel as soon as possible.

You very well may be the victim of a medical error, but that does not mean that you have a viable medical malpractice case. Most good lawyers won't take a medical malpractice matter unless the damages are catastrophic. You should talk to some local lawyers in Wisconsin to see if anyone is interested, but I doubt it. Good luck.

  • Can I be charged with a felony for a hit and run I was unaware of?

I was driving by some school and I think there was this bus in the way or some truck. So I tried to switch lanes, but I didn't see my blind spot and some car was there so the guy beeped at me and I swerved out and I know I didn't hit him because I...

You should consult a criminal lawyer in your area and also talk to someone from your car insurance company. Don't ignore this. You may have a reasonable explanation for everything that happened, but if you choose to ignore something from the Court or from the other driver, that could create big problems for you. Talk to a lawyer ASAP

  • Confusing worker's comp car accident issue

I got in a four-car fender bender on the freeway while driving the company car to an appointment. The car two cars behind me hit the car behind me, which hit me, causing me to hit the car in front of me. So we've got three insurance companies for ...

You should not have to pay the lawyer a retainer to pursue your case. My thought is that if the lawyer is asking you for money, it's a sign that he does not believe in your case. It is certainly not the standard practice in personal injury cases for the lawyer to get a retainer from a client in order to file a lawsuit.

  • Can patient sue for getting a DVT in hospital/SNF?

Patient was in hospital for an infection and transferred to a skilled nursing facility, where she was diagnosed with a deep vein thrombosis. The only preventative therapy she was given was baby aspirin. No heparin, etc. Is this a basis for a lawsuit?

    Bruce’s Answer

Medical malpractice laws vary by state. Find someone in PA who specializes in medical malpractice. Proving a breach of the standard of care is a complicated matter that requires an expert opinion. If you can prove that there was some act of negligence on the part of the hospital or skilled nursing facility, then you may have a viable claim. Good luck

  • Am I really at 50/50 fault for this? I just want them to fix my car.

I was rear ended by a driver named Dew while entering the hov lane. I guess at the same time he was trying to enter it as well. He stated that on the police report he was going too fast to avoid hitting me. I had to talk with his insurance company...

    Bruce’s Answer

Talk to a personal injury lawyer in your area. Specifically, find someone who has experience and interest in taking cases to trial. Many insurance companies play games like this because they can do it and not be held accountable. The only way to hold them truly accountable is at trial. When they know that they're going to be made to pay, that's when they will try to settle. Good luck.

  • Who is responsible of a car accident when the paid parking lot warden command to park the cars double parking?

I parked my car at the paid parking lot in the parking facility next to pillar. At the time there was no double parking. When I came back there were about 10 cars double parking even if there were two wardens nearby. A warden came to me and said h...

    Bruce’s Answer

It seems as though you should contact the owner of the parking lot to complain. It may be that the incident was captured on their security cameras too. Depending on the cost of the repair to your car, you may or may not be able to find a lawyer to handle the case, since many lawyers won't take a property damage case that does not include injuries. Good luck.

  • I bought an accident car from a used car dealership and they didn’t disclose that to me.

I bought a car from a used car dealership for $6,400, when I took it to work the next day. It didn't feel right and the steering wheel shakes when I go over 65 mph. I went over the dealership and told them about and asked them is it was an acciden...

    Bruce’s Answer

Disclosure requirements vary from State to State, you should definitely check with a Consumer Protection lawyer in Ohio if that's where you purchased the vehicle. Also, not every accident needs to be disclosed. Some are simply fender benders, while others may be much more significant. There are also services like Carfax available for folks to check prior to purchase. Good luck

  • What do I do if an insurance company denied my car accident claim due to word-of-mouth?

A car slightly collided with mine, and it left minimal damage. Georgia Farm Bureau has denied my claim due to "word-of-mouth". A police report was filed.

    Bruce’s Answer

If you can't get the insurance company to pay your claim voluntarily, then you can always seek justice in Court by filing a lawsuit. Depending on the amount of damage involved, you can probably file in the appropriate Small Claims Court in your area, which is usually a faster way to get a result than a full blown jury trial. Good luck

The law in every State is different but there are circumstances in which the relationship of the claimants to the party responsible for the wreck could preclude coverage. You should contact a personal injury lawyer in your State to get a definitive answer. Good luck.
