Last year I was charged with a DUI as a result of testing at a 0.08 BAC during a road block operation. I was certain I had at least a chance of winning the case due to several issues that occurred during the incident, namely with the intoxilyzer malfunctioning and testing at such a low BAC. Being a ...pretty practical gal, I wouldn't have hired anyone if I thought it was open and shut, if I had a high BAC or the intoxilyzer hadn't shut down during my encounter with it. I decided it was worth the cost to hire an attorney because of the issues with my case. Dustin came to my attention through a recommendation by a former Wilmington PD officer. After looking through some reviews and phone consultations with other attorneys (some less and others much more expensive) I went in for a consultation and was confident in his competence and ability to represent me well. During the week of my trial he informed me that he and his wife were expecting their first child and that he may have to have one of his partners handle my case. His partner ended up handling my case that day and I was disappointed with the outcome. Dustin called me after speaking with his partner and expressed his regret and offered to waive the $4000+ fee to take the case to a jury trial. After a few days of consideration I decided to take the offer, which would mean my flying back to NC from OR in five months for a second shot. In handling my jury trial Dustin maintained the same level of service as earlier. During the jury trial there was a point at which we both felt we had it in the bag and Dustin turned to me and said he didn't think I needed to testify. I was hesitant but I felt confident in my ability to represent myself on the stand (no prior convictions, well dressed, respectful, etc.) so I told him I wanted to go ahead with it. After being found not guilty Dustin spoke with the jurors and at least one had said that my testimony was what had sealed the deal in my favor. In the courtroom Dustin had a strong but respectful presence and a good repertoire with the DAs that handled my trial as well as other court staff. If you think you have an issue with your criminal case, take a consultation with Dustin. If he says he thinks you've got a shot at winning your case, you probably do. Hire Dustin. He went above and beyond in a less than desirable circumstance when he was by no means required to. If you feel like your testimony will aide in a more favorable outcome and he thinks you're well suited to provide one, do it. Especially in a jury trial. He'll guide you well in the process.
