  • I want to know was I advised right that I can possess these types of fire arms?

In 2009 I was charged with assault with a weapon and assault on a female domestic violence. I got a lawyer and was advised to use a prayer for judgment or PJC. I was advised I would not be allowed to buy a handgun but would be able to still but sh...

    Dennis’s Answer

Under N.C. law you can possess a firearm. However, under federal law you cannot. 18 U.S.C. 922 d(9) says that any person convicted of a domestic violence offense is prohibited from carrying a firearm. The federal case law does not recognize a PJC and counts them as convictions. Most lawyers don't even know this.

  • What should I do

I missed my court date it was 1-7-16 I thought it said the 17th the charge is driving under suspension but I'm not under suspension

    Dennis’s Answer

Hire a local Criminal attorney to help you through this. There may be a bond and an order for arrest outstanding. An attorney can help you with this, and probably save you money in the long run.

  • When can I apply for a conditional license or driving privilege? Have not had any other tickets.

DUI conviction date of 06/13/2013 and 06/002/2014. First DUI ticket was 12/13/2012 and second was 02/01/2013. Have satisfied all the state requirements and fines.

    Dennis’s Answer

You are eligible to apply for a DMV reinstatement hearing on the second anniversary of your second suspension. Your license was revoked for four years, but you are eligible for a hearing after two. You absolutely should hire a lawyer to help you with the hearing. If you are unsuccessful, you will have to wait a year before you are eligible for another one.

You should see an attorney immediately to plan a course of action. If you had sex with her, you are facing almost 20 years in prison. See a lawyer before you turn yourself in on the warrant.
