    Communicating a threat is a serious charge in North Carolina. This sounds like a "people's case." She went before a magistrate and made her complaint. You will need a lawyer to defend you. Though in Wake County these are cases that are usually not very difficult to win in court with an attorney on your side. You will want to try to get the case dismissed and then later expunged from your record.

    You may be eligible for an expungement. If so an expungement would erase all public records (including the court file). See the link below for information about North Carolina expungements.

    Typically there is a section in the Wake DV agreements that precludes you from getting an expungement. You would need to look into the signed agreement in the court file.

    If you don't have any other convictions on your record and 15 years have passed you may be eligible. There is a bill in the Legislature that may change that wait to 10 years. If it passes it would go into effect in December of 2015.
