    Description:
    A fellow practitioner filed a complaint against this respondent. My client (the respondent) followed all procedure set out by the NC Board of Psychology and was brought up on charges from administering a test the Board deemd as outdated. My client admitted administering this test. The Board's handling of the collection of evidence was suspect from the intial complaint. This case was heavily litigated and no stone was left unturned in my pursuit of preventing this unjust prosecution. After the primary depositions were over, so was the State's case. A real tough piece of litigation against a formidable regulatory board.

    A fully litigated condemnation case starting with a motion to dismiss Plaintiff's case (12b7) - granted and amended to further discovery litigation that admonished Plaintiff and finally motions in Liminie that were argued when the Plaintiff gave the Defendants what they wanted. A good settlement from tough litigation. We were ready, willing and extremely able to take all the facts to the jury. Congratulations to my clients!
