  • I was convicted of a misdemeanor for a reckless driving ticket already in colonial heights and I have 14 days of jail time.

    Is there any way I can switch it from jail time to community service? I am in college and working so all my time goes into studying and working just to pay for books and my car note. Is there anyway I can change it?

    You are interested in obtaining a much better sentence than your original sentence. That calls for your consulting right away (well before the appeal deadline passes, if said deadline has not passed yet) with your original lawyer or another competent lawyer, to include assessing the risks and possible benefits of appealing and seeking a sentence reconsideration.

    As to seeking a sentence reconsideration, I particularly urge caution about relying on the possible benefits of such a motion, in general (as opposed to with the particular case against you.)

  • How do I go about court for a charge of underage possession of alcohol as a 19 year old without an attorney?

    If you proceed to court without yourself, you are proceeding on an uneven playing field.

    When you obtain a qualified lawyer against this jailable and potentially damning charge, your lawyer can explore such defenses as challenging the admissibility of the breathalyzer test, challenging the evidence, and challenging the existence of reasonable doubt about whether if you consumed alcohol, whether that might have been in DC or Maryland versus Virginia.

    I submitted to FSTs and roadside breath. Refused breath/blood at station. Transported to the hospital after having an anxiety attack. I am also in the military and facing several issues as well.

    Refusing a breath/blood alcohol test can make it harder for the prosecutor to prove DWI, but exposes you to prosecution for refusing the test.
