I had dinner and a few drinks in Bethesda with my girlfriend and we left the restaurant about 11 o’clock on a Friday night. I decided to drive thinking I was okay. I drove up Wisconsin Avenue and noticed a drunk-driving check point. Before I could find a place to turn off, I was already driving through the check point with cops lined up waiting to ask us if we were drinking. I had to stand on one foot and recite the alphabet. Things I would have a hard time doing anyway, but especially when you are nervous.
I failed the stand on one foot for 20 seconds test. I went to the station and blew a .09. A few years ago that would have been a little under the limit. However, I was over the limit and I was freaking out because I had two DUI’s from over 20 years earlier. I knew that these things never left your record and that I would count as a repeat offender. That night, after I was released on my own recognizance, I was so wired and nervous I decided I needed to get an attorney as soon as possible. I searched under DWI attorney in Silver Spring and Gary’s name appeared. The testimonials I read were like the one I am writing now. They described how scared and desperate they were especially those with prior convictions. I called and left a message and Gary called me back Saturday morning. First, he acknowledged my humanity by saying he was sorry my evening was ruined. It was exactly what I needed to hear from him. He told me everything would be okay. I felt better right away.
The first thing he did was advise me to go to DMV on Monday and get a new license. He said it would take a few days for the paperwork to arrive. I went down Monday and got my license. He was correct. I felt better already. So far, they were right. Next, my first trial date was scheduled for a Friday before I was to attend a family reunion with my whole family getting on a plane. I couldn’t tell my mom that I couldn’t make it because I had a trial that day. I needed a continuance. They promised me I would receive it. Even though the courts waited until a week before my reunion, Rebecca told me to enjoy the reunion as my continuance was granted.
The trial arrived a few months later and I was a nervous wreck. Gary appeared and said that proving a checkpoint case in Maryland requires a high standard. He really knew his stuff. Hew noticed that the watch commander was missing. He told me that we should try for a trial now and that everything was appealable. I said, “Let’s go.” I trusted him completely. At first, the prosecutor argued that the missing commander was caused by them not receiving a summons. Gary argued that it was the fault of the state and they failed to notify him. He even called out the state as being disingenuous. The state asked for more time. An hour went by and I watched the Judge sentence one person after another to long periods of supervised probation. I was in a daze. Finally, Gary said it was time. He said you are going to like this outcome. Gary knew the Judge would not grant another continuance even if I asked for the first one. I stood in front of the Judge. The state said something. Some Latin was spoken. A Minute later, I was told to wait for two pieces of paper. I waited and then I was handed a piece of paper that said, Noloprosecur and had zero’s all over it. All charges were dropped. I started to feel this incredible relief for the first time in six months.
The following week I went to the DMV and I was handed a 45 day restricted license with Rebecca representing me. The amount I paid them was so far below what it was worth, but they do charge a fixed fee for both the trial and the DMV hearing and that makes it even less stressful.
I am so indebted to Gary, Rebecca and Sara that I will name my next cat, Gary, if it is a boy and, Rebecca, if it is a girl.

Absolutely, the Lawyer for ME!!!! Mr. Gerstenfield is a great lawyer. He is like tv lawyer. Go to court and watch him in trial. He represented me and was awesome!

My son had just started his senior year in high school, when he was charged with a very serious felony of First Degree Burglary. My son had no previous record. He had just gotten involved with the wrong group of kids. He was facing a possible maximum prison sentence of up to twenty years! Needless to say, I was a wreck!
I did an Internet search for the top defensive attorneyâ€™s in the state! Gary Gerstenfieldâ€™s name was on that list. We talk with a few other attorneysâ€™, but Mr. Gerstenfield was the only one that spoke with confidence of handling my sonâ€™s case. He was always available by telephone and even called us at home at night if he had been in court during the day.
Mr. Gerstenfield was professional, ethical, and hard working. He was proactive on the case, and when we had our court date, my son had already completed all of the things that the judge requested, thanks to our attorney being very knowledgeable.
He provided peace of mind and support with every step of the case. We were well informed of what to expect. My son avoided jail time and received three years probation before judgment, and after serving one year of the PBJ, he had everything lifted for good behavior!
My son was able to graduate, and now he will be able to get a job, join the military, and most importantly he has his life back and can move forward and put this behind him! (Just a note, the other young adult involved got a cheap attorney, and he is serving 18 months).
We would strongly recommend Gary Gerstenfield and will be eternally grateful for his service!
