Outcome: Suppression of Evidence affirmed on appeal

Description: This was an appeal by the State's Attorney for Montgomery County from a trial court ruling that Defendant had not been arrested with probable cause and suprressing all fruits of the arrest. The trial court was affirmed and because this was a state's appeal, all costs including attorney fees, were paid by the Montgomery County State's attorneys office pursuant to the Maryland Statute granting the state a limited right of appeal. Moreover, upon remand, the Courts ruling was used to Collaterally estop the State from forfeiting the clients vehicle under the Supreme Court ruling in the 1957 Plymouth Sedan case.
