  • Can I sue the driver and the company she works for or just the driver herself?

I was in an auto accident with a school bus driver and was with my daughter. She rear ended me at a red light or yellow light. I'm now experiencing health issues months later.

    Gary’s Answer

You have plenty of time to pursue your claim, in Delaware up to 2 years from the date of accident. You can still call the police and report the crash to make sure there is some investigation. Consult a doctor about your injuries, and consider legal representation to protect you and your family.

how does uninsured motorist pay out in a claim

    Gary’s Answer

Um carriers can pay on more than 1 policy if there are separate uninsured tortfeasors. Also, if each um policy is with a separate carrier, not the same one , you can stack those policies if the injuries warrant. Call a lawyer with experience.

what should my next step be

    Gary’s Answer

You should contact a competent attorney that specializes in the type of case you have. Only time and further testing will determine what ongoing problems you have from this. The most important thing is to make sure you know everything that is wrong with you before you attempt to resolve your claim. Remember the compensation needs to equal the harms caused.
