This appeal to the Commonwealth Court established the principle that a worker's pre-injury employer must provide the worker with timely notice of a medical work release BEFORE the injured worker is asked to return to work. The purpose of the notice is to allow the worker to consult with his doctor or other advisers so he can make a meaningful decision about his ability to return to the position being offered.
